Terms of Service

These Terms of Service ("Terms") govern your use of W-App (the "app") and the W Lifestyle website (w-lifestyle.com). W-App is operated by Jared Craven-Griffiths, an Australian sole trader based in Queensland, Australia ("we," "us," "our").

By using W-App, you agree to these Terms. If you don't agree, please don't use the app.

W-App is a nutrition tracking mobile application that helps you:

• Set personalised daily nutrition targets based on your profile
• Log meals and estimate macronutrients (using AI-assisted analysis)
• Track your progress over time
• Reconcile your daily intake based on how your training and day went

W-App is not a medical device, medical service, or professional health advice. See section 8 below.

To use W-App, you must:

• Be at least 16 years old
• Have the legal capacity to enter into a binding agreement in your jurisdiction
• Not have been previously banned from using W-App

If you're under 16 or don't meet these requirements, don't use the app.

To use W-App, you need to create an account with a valid email address. You're responsible for:

• Keeping your account credentials secure
• All activity that happens under your account
• Notifying us if you suspect unauthorised access to your account

You can delete your account at any time via the Settings screen or by emailing info@w-lifestyle.com.

You may use W-App for personal, non-commercial purposes. You may not:

• Use automated tools, bots, or scrapers to access the app
• Reverse-engineer, decompile, or attempt to extract the source code
• Attempt to bypass any security measures or access controls
• Use the app to send spam, malware, or harmful content
• Resell, redistribute, or commercially exploit access to the app
• Impersonate another person or misrepresent your affiliation
• Use the app in a way that violates any law

We may suspend or terminate your account if you violate these Terms.

When you log meals, add photos, or enter profile information, you retain ownership of your content. However, you grant us a limited license to store, process, and display that content as necessary to provide the app's functionality.

We don't claim ownership of your data. If you delete your account, we delete your content in accordance with our Privacy Policy.

W-App uses AI to estimate the nutritional content of meals you log. Please understand:

• AI estimates are approximate. Actual macros may differ from what's shown, sometimes significantly.
• We source data from publicly available nutritional databases and AI models. We don't guarantee accuracy.
• Do not rely on W-App's estimates for medical purposes, allergen management, or any decision where precise nutritional information matters.

If precise nutritional accuracy matters to you (e.g. clinical dietary requirements, allergen management), verify information with product labels, dietitians, or authoritative sources.

W-App is not a medical device and does not provide medical advice.

The information W-App provides — including nutritional targets, meal analyses, and daily recommendations — is for general informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified health professional (doctor, dietitian, or similar) before:

• Making significant changes to your diet
• Starting or changing an exercise program
• Managing any medical condition (including but not limited to diabetes, eating disorders, kidney disease, or cardiovascular conditions)
• Using W-App if you are pregnant, breastfeeding, or have any existing health condition

If you have any concerns about your health, consult a doctor. Do not delay seeking medical advice because of information you received from W-App.

If you have or have had an eating disorder, or if you're at risk of developing one, please consult a qualified professional before using calorie or macro tracking apps. If you're in Australia and need support:

We may modify, suspend, or discontinue W-App or any part of it at any time, with or without notice. We're not liable for any changes or discontinuation.

We do our best to keep the app running smoothly, but we don't guarantee 100% uptime or that the app will be error-free.

W-App relies on third-party services (Supabase, Vercel, Anthropic — see our Privacy Policy). We're not responsible for the availability, terms, or actions of these third parties.

W-App is provided "as is" and "as available" without warranties of any kind, express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, consequential, special, or punitive damages.
• Our total liability arising from your use of W-App is limited to the amount you've paid us in the last 12 months. If you haven't paid us anything, our liability is limited to AUD $100.

Nothing in these Terms limits liability that cannot be limited under Australian law (including under the Australian Consumer Law).

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your misuse of W-App
• Your violation of any third party's rights (including intellectual property or privacy rights)
• Content you provide through the app

You can stop using W-App at any time by deleting your account.

We can suspend or terminate your access if you violate these Terms, with or without notice.

Upon termination, provisions relating to intellectual property, disclaimers, limitation of liability, and indemnification survive.

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland, Australia.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

We may update these Terms from time to time. If we make significant changes, we'll notify you via the app or email. Continued use of W-App after changes means you accept the updated Terms.
